Sitting in Father’s seat

Question:

Hello,
Can one sit in the seat his father generally used to sit for davening, when his father has moved his seat because he is in his year of aveilus?

Answer:

If it is his father seat the child may not sit there, even though his father is temporarily not sitting there. The place is still considered the father’s place even though he isn’t sitting there now.  There is however an idea that a father can be mochel on his kavod.

A big talmid chacham once brought a proof for this. The Rema Y:D 93-2 says that a person should not sit “b’mikomo” during the year of aveilus. Obviously it is still considered his makom for that year.
