Question:
I ordered a baby toy on Amazon, it was super cheap and came from China. When it arrived, one of the 4 items appeared to be a bit damaged and another item was covered in dust. The box was also broken. It came in a non-acceptable condition. I wrote to the seller that two items are damaged and sent him pictures. He gave me the money back including the shipping. However, I cleaned the toys and saw that they are ok to use and I gave it to my baby who loves them and plays with them. Now I feel that I am using something I did not pay for. What would be the right thing to do?
Answer:
Hello,
It is permitted to keep it. The reason is that you didn’t fool the company’s representative, it came somewhat damaged, it is just that now you see that the “damage” wasn’t substantial, rather it just came looking ruined. Now that they allowed you to keep it for free, there is no need to return it to the Chinese company.
There are times when it would be recommended to return such an item to a gentile company, to make a kiddush Hashem, however when dealing with a company over the internet, they will not know who you are and the kiddush Hashem will not come out of it. Therefore, you do not have to do anything about it, and you can enjoy the toy.
Best wishes
