Selling Items After Wearing

I own a childrens clothing store.
I sometimes take clothing home, and use it once twice and decide that I have taken way too much home, and I don’t need it.
It’s not washed out-cause it’s like new.
Or it could happen that an item was washed out, but it can not be seen. and is still like new.
But if, there would be something wrong with it (cause it was used and it got stained, and I would still like to return it, then I would give it a discount price).

Now, in the store I have all the time people trying on clothing..
Very often clothing gets: torn-stained.. and even really damaged, where I have to discount it.
So I am used to having items around that aren’t always perfect-and when people ask for a discount on it-they usually get.

I also let people come back months later with an item, to either change a size or change to something else-after I check it and it looks in new condition..
Of course, I wouldn’t appreciate that people buy things-use it and return it in general…
But if there were someone that asks me as a favor to return an item that she tells me was used-BUT if looks just right-I would do it and take it back from her.

1) Am I allowed to return an item that I used slightly and if needed offer a discount on it???

2) I once had a customer that used something slightly.. she wanted to return it-it wasn’t in perfect condition but it was decent, and I put it out on the shelf at a time when everything was at huge discounts, where people just grab what they see..(but if they see something that doesn’t look right, they still ask for a discount..,WAS IT OK?

Answer:

The general assumption of buyers is that clothes for sale have not been used and returned after a while.

Therefore, such clothes should not put out for sale, unless they are singled out by a special price, and explanation that the clothes are not “entirely new.” If this is done, it is of course permitted to re-sell the items of clothing.

This is not the case for items that have merely been tried on. Everybody knows that clothing put out for sale is sometimes tried on by potential customers, and there is no need of course to make this known.

It is very highly commendable that you are asking these questions, and are aware of the delicate matter of halachos pertaining to Choshen Mishpat.
