follow up on camera question

Here is a question that we recently sent in with the answer. There is point that my daughter wants to be clarified: She told my son “if anything happens at all to the camera, even if only something minor, you will pay me for the camera without any discussion” and he ageerd. Does this affect the din? Thank you.
Question:
We were on a family trip. My son asked to borrow my daughter’s camera for a short while. She agreed on condition that he takes full responsibility. He said ok, borrowed it and it stopped working. The screen was black, it wasn’t out of batteries… He paid her for the camera and she went and bought a new one. (he also decided to buy one for himslef) A few weeks later the”broken” camera started to work again! My son wants his monet back. My daughter says that it was broken to tehir knowledge and she already bought a new camera with the money. What is the din?

If indeed the camera is now working well, then the payment given was a mistake and it has to be given back. As a side point it is worthwhile to wait a week or two to determine that the camera is working properly.

From reading what your daughter said doesn’t mnean that your son has to give her a new camera if the outside case gets scratched. It means that if he has to pay her, he won’t give her a hard time, which he didn’t. The issue though is that what he paid her ended up being a mistake, since the camera was not damaged at all.
