Question:
A person who did not previously gave maaser kesafim and is starting now, should he go back and give maaser on his prior income (if he can somehow remember how much he earned), or start from now and not worry about the past?
Answer:
There is controversy is the obligation to give maaser is an biblical, or rabbinic obligation or if it only a very strong minhag. Most poskim say that indeed it is only considered a minhag, therefore you do not have to give maaser on money that you earned previously.
As a side point before accepting upon yourself to give maaser it is very advisable to say that you are only doing it bli neder. Additionally in the sefer Sharei tzedek 8-24 he brings a very nice nusach that one should say before starting to give maaser, which will solve numerous issues and questions that may arise. Here it is.
“הנני מקבל על עצמי בלי נדר מעות מעשר כספים. והריני מוכן ומזומן להפריש מעשר מממוני כמו שאמרו חז”ל ואסמכוה אמצות עשה שצוני בוראי יתברך שמו בתורתו הקדושה להפריש מעשר שנאמר “עשר תעשר את כל תבואת זרעך” ונאמר וכל אשר תתן לי עשר אעשרנו לך. ומפיל אני תחינתי לפניך מלך רחמן שתתן לי תמיד פרנסה טובה וכלכלה ועושר וכבוד לי ולזרעי עד עולם. ואין דעתי לנהוג כן לעולם רק כשארצה. ואין כוונתי להתפיס את הכסף המופרש לצדקה גם כשאתננו לתוך הקופה המיוחדת לכך רק כשיבוא לידי עניים. ואני מכוון בזה שאוכל לתת את המעשר באומד. ובאם אוסיף לתן יותר מהמחויב יהיה בתורת צדקה בעלמא ולא בתורת מעשר. ובאם ארצה אחשב את תוספת המעשר על חשבון הריוח העתיד לבוא ודעתי שאוכל להוציא ממעות מעשר גם לדבר מצוה. ובכלל זה גם מצות הלואה לעניים ולעשירים. והריני קובע בזה זמן לעשית החשבון של המעשר עד עשרת ימי תשובה שבכל שנה ושנה.”
Additionally the Chofetz Chaim writes in Ahavas Chesed 20-6 that when a person accepts upon himself to give maaser, he should think that he is entering into a partnership with H-shem because now his business of tzedakah. Additionally, when entering into a business with HKB”H, you know that you have a great partner!!
