Question:
I am busy packing away my succah and I am wondering if it is suitable for next year. Over Succos numerous times cats managed to make their way into my succah. My neighbor commented to me if you are scared then you are mitzta’er and exempt from sleeping in the Succah.
The halachah is that if a succah is not for eating and sleeping then it’s not kosher. I was wondering what the din is by cats. Does the fact that I am scared to sleep in my succah because of cats, make my succah pasul?

Hello,
Your question essentially effects many people, especially in areas where it is very cold, and even with many blankets one will not be able to sleep, or in places where mosquitoes or flies will be bothering the person. The poskim (Mishna Berura and Aruch Hashulchan see sources) say, that the idea that if one can’t sleep in the succah that he isn’t yotza even for eating, is only if the person has another place to build his succah, and he builds it in a place that is cold, or in a place where animals will disturb his sleep. However if the whole area is this way, and the person doesn’t have any other place to build his succah, then it is still kosher and he may eat there. The reason being, that no one builds a house in a place where he will be disturbed if he has another place that he can build it. However, if the person doesn’t have any other place to live, the person will live in an uncomfortable place. The same is with the succah, if the person has no comfortable option then the succah is kosher, however if he does, then he should not build his succah in a pace that he can’t sleep.
