Candy wrapper and muktze

Question:

My wife brings our 3-year- old to join me at shul on Shabbos mornings Baruch Hashem. The first thing he does is visit the “candy man” and take a candy. I know that candy wrappers become muktze once you eat the candy but you are permitted to walk to a trash can and throw out the wrapper appropriately. Sometimes I can ask my son to throw the wrapper in the bin, but sometimes it is difficult (the trash can is far away and I don’t want to interrupt other people who are davening). Given my son’s young age, I can’t always trust him to hang on to the wrapper. I also don’t want to leave rubbish on the floor of the shul.

1. Am I permitted to take the wrapper from my son and throw it out myself? Or would that be considered handling muktze.
2. Can I put the wrapper in my pocket until I get to the trash can?
3. If it is a problem, what can I do about it?

Hello,

1. According to most poskim, even if one person has muktza in his hand in a permitted way, (it wasn’t muktza when he picked it up) he may not[1] give it to someone else. Additionally, even if a person has muktza in his hand it should preferably be placed down as soon as possible, i.e., in the garbage, and not just held longer than needed.
2. The poskim discuss an idea similar to the above case. Is it permitted for a person holding muktza that was picked up in a permitted way (it wasn’t muktza then) to transfer the muktza from one hand to another? Regarding this although there is controversy about it, many poskim permit it. However, putting the muktza in one’s pocket would be similar to putting it down as he isn’t actually holding the muktza now.
3. Therefore, the child should take the wrapper to the bin right away, or you should unwrap the candy, and while it is in his hand, take it straight to the bin. If the wrapper did fall on the floor, although it is muktza, and may only be picked up through something else[2], (tiltul min hzad), or you can mve it outside with your foot, or push it to a place that is hidden (under a bench, and put it in the bin after Shabbos.

ולענין לעבירו לידו של השני החכמת שלמה (סי’ שח סעי’ ג) מתיר אף ליתנו לחבירו, וכן פסקו הפרמ”ג (סי’ שלו א”א ס”ק יג, ע’ סי’ תמו מ”ז ס”ק ב) ואליה רבה (סי’ שלא ס”ק ה, מובא במ”ב סי’ שי ס”ק טו), וכן צידד התהלה לדוד (סי’ שלא ס”ק ז. מאידך , במחצית השקל (סי’ שלא ס”ק ה) הקשה על דברי האליה רבה. וכן פסקו בשו”ת אז נדברו (ח”ח סי’ לז) ושו”ת שבט הלוי (ח”ג סי’ ל אות א). וכן לדעת התוספת שבת וסייעתו שאסור אף להעבירו מיד ליד, כ “ש שאסור ליתנו לחבירו, וכ”כ בפסקי תשובות ס’ ש”ח אות ט”ו, וכן ע’ שמירת שבת כהלכתה פרק כ אות כו

קליפות, גלעינים ועצמות שאינם מאכל – אדם, ואף לבהמה אינם ראויים, או אפילו ראויים למאכל – בהמה אלא שאין בהמה מצויה באותו המקום, הרי הם מוקצה ואסור לטלטלם*, וראה להלן פרק כב סעיפים לח ו – מו. ואמנם מותר לקחת קליפות, גלעינים ועצמות אלה כאשר מוציא אותם מן הפה ולהניחם על הצלחת.

(המפצח גרעינים, אל יחזיק את הקליפות ביד על – מנת להשליכן כעבור זמן, אלא ישליכן מיד עם הפיצוח או יניחן על הצלחת). ולדבריו כ”ש שלא יתנו לידו של חבירו.
